Empathetic Elena Kagan: Obama's Pick for Supreme Social Justice

And we have another one to add to the Obama radical List, folks.

Elena Kagan, American Socialist.

There's just an endless source of these America changers.

Does Obama know ANYONE who isn't radically left of left?

The socialist Change-machine just gets worse everyday.

I read that about 5% of 'ambiguous' laws reach the Supreme Court for review.
Here is a taste of what Obama's society organizers think about ambiguity:

Obama's Regulatory "czar" Cass Sunstein:
"There is no reason to believe that in the face of statutory ambiguity, the meaning of federal law should be settled by the inclinations and predispositions of federal judges. The outcome should instead depend on the commitments and beliefs of the president and those who operate under him...and...The executive should usually be permitted to interpret (law) as it reasonably sees fit" (1)

Under Sunstein there would be no need for a Supreme Court to interpret law.

Now they know they can't get some of this Nut-case's regulations to stand up if their coming dictatorial regulations are shot down by The Supreme Court so the extreme tyranny deck continues to be stacked.

Kagen (who is also in Obama's health-care camp) believes in "Presidential control of administration, in critical respects (expanded dramatically during the Clinton years) making the regulatory activity of the executive branch agencies more and more an extension of the president's own policy and political agenda. She argued that an increased presidential role in regulation "both satisfies legal requirements and promotes the values of administrative accountability and effectiveness." (2)

In fact a large part of Kagan's Constitutional teachings at Chicago law School involved Presidential Law, Presidential Administration, Labor law and the very same ideological Sunstein Marbury Nudge: The Executive's Power to Say What the Law is.

Kagan and Sunstein, also co-authored an 18 page pamphlet together (3) on Remembering "TM" (Justice Thurgood Marshall), and know each other well from their days at Chicago's law School. I read that it was Kagan who got Obama his lecturing position there.

Another factor putting Kagan at the top of Obama's 'change' agenda is that she echos the view that the Court’s primary role is to “show special solicitude” for people that a judge has empathy for.(4)

It was Senator Obama who feels, 'The role of a justice is to favor the weak over the strong. In the most difficult cases, the determining factor is not what the law in question says, or what the Constitution says. In those difficult cases,' " what matters is "what is in the judge's heart."(5)

Social Justice? Empathy? Ignoring the law? Casting aside the Constitution favoring class?
Sounds more like 'unequal justice'.


Kagan wrote in her Princeton thesis, ("To the Final Conflict: Socialism in New York City, 1900–1933”) “Americans are more likely to speak of a golden past than of a golden future, of capitalism’s glories than of socialism’s greatness. Conformity overrides dissent; the desire to conserve has overwhelmed the urge to alter. Such a state of affairs cries out for explanation.”

These people Obama has gathered around him all speak the same altering Marxist language and yet, they, and their media counterparts, refuse to even admit who and what they are.

Kagan is cloaked in folksy distraction instead. She plays softball and poker - the kind of person you can have a beer with.

On the demise of historical socialism's greatness and a hand slap to bickering factions Kagan wrote:"... :( a sad but also a chastening one for those who, more than half a century after socialism’s decline, still wish to change America … In unity lies their only hope."(6)

HOPE.

CHANGE.

Kagan also wrote of hope that the future growth of liberalism would “be marked by American disillusionment with conservative programs and solutions, and that a new, revitalized, perhaps more leftist left will once again come to the fore.”(7)...note: numbered sources are in below comment area.

..."that a new, revitalized, perhaps more leftist left will once again come to the fore"...gee- I wonder what is left of left and who are the gatekeepers to be?

Well, the leftist left is here people and it's soldiers (as Kagan's radical MARXIST (8) brother calls himself) are uniting for power in every branch of our government to change America.

Have negative polarized labels like "Party of NO" succeeded in silencing resistance to this take over?

The question now is will the Republican Senators be the Party of NO DAMNED WAY! or give barely audible lip service and continue to allow our American foundation to be transformed by these radicals as they whine that they are in the minority and how difficult it will be to vet Kagan's beliefs because of her lack of legal decisions...and, of course, 'touchy' floor protocol on personal questions.

If the outnumbered Patriots had just shut up and gone home because things were difficult there would be no America today.

Here's the protocol. Do YOUR dam duty and Protect and Preserve the Constitution.

Even the Republicans say she will be confirmed because their is nothing in Kagans background that they can attack. You lose you moron!

I am not a registered Republican - surprize!
I have discovered that I am quite conservative though.
Those who say the tea party needs to meld with Republicans to win elections are wrong - the Republicans need to return to the ideals of the tea party or become a democrat.

Teabaggin cracker- I didn't find anything racist in my article though unless you meant tea and crumpets your response was typical of the left 'race card' users I suppose.
I absolutely judge a person by their 'character', son, and if you do not agree with what I write - show where I have strayed and am incorrect- or move on.

If Obama's internet goon squads takes me off the web there will be no great loss - others are smarter, better at making their points, better researchers, skilled writers, and provide the free information all people need "to make CHOICES".
You have a choice not to read here. You have a free choice not to read anything on the internet.

If oppossing view is considered lies and they take down opposition - why then is not your own oppossing view a lie?

In Obama's world you only read, listen, and access information he provides. And by 'he' I refer to that whole tribe of radical philosphers Obama has assigned to agencies to sieze and control our freedom of choices in every area of our lives.
The problem as you have noted is Obama's gang, and You, want to silence all oppossing thought and information by calling them lies.
Obama takes it further and discribes information as - distractions- and a threat to democracy...Nut-case Sunstien wants to TAX desent. He wants to "infiltrate" chat rooms and websites and disrupt free speech and cause chaos.

What is left, (no pun) if they control 'information', is only THEIR opinions.
There would be no options to their 'truth'.
Obviously no freedom to express desent.

You see they can NOT do it without you. It is much like the Media- they could never have gotten this far if the media had protected this country.
If you do not understand where silencing "my lies" will leave you then I am sad for you.

...but when they came for me- there was no one left to help me.

If you are looking for 'truth' then try looking for it rather than being fed Obama propaganda.

You should get your facts str8t. Kagan's thesis was nothing more than a writing about the social movement in New York. There is nothing in the thesis that implies that she is a socialist. There is nothing in her paper trail to say she is socialist. You people just make things up like shes a lesbian and a radical. So what? Who cares?

Reminds me of Holdren saying the Arizona Law is a bad law- maybe UnConstitutional says he- but when asked he admits he hasn't even read it.

Always something to divide people in this Obama club.

I'll try to clarify what I obviously didn't make clear in my original write-up.

In her very own words, Kagan mourned for a day when a party to the left of leftist-liberalism will come again.

For those who wish to cloud this issue by saying she was simply writing about a historical event in her thesis I disagree and remind you of her later more sober moment when she wrote:
a hope that a new, revitalized, perhaps more leftist left will once again come to the fore.

What is it to the left of liberalism that Kagan wishes to come to the fore?

What left of left liberalism politics has she written of in the form of it's sad "demise" that she later in life would lament a revitalized "once AGAIN" wish for?

The words REVITALIZED and "once again" are very key to tying the two writings together from the historical sad demise to a personal future Hope.

You can deny the logic in the key but I can not agree with you. She has been a socialist in waiting.

This continued denial of the "socialist" tag must mean that there is something very wrong with it that must be silenced, eh?

Otherwise stand up and declare yourself.
